    Need some advice / opinions please

    I used to have an old golf GTi. Despite my best efforts, Trev didn't buy it but I've now sold it. Bloke has paid in full, V5 filled out and he's just driven off into the sunset so all is good

    Thing is I "sold" the car last Saturday to a bloke. We agreed a price, he gave me a £200 deposit and that, so I thought, was that until I got a phone call on Monday on my way home from work saying that something's come up with work and they've asked him to relocate or lose his job blah blah blah so he unfortunately can't buy the car because of his job and nowhere to store it etc etc. I think this may be a bit of a porky as he mentioned that he lives at home with his mum and dad and they done have a garage for him to tinker in and he hadn't told them yet about getting an old golf so I reckon that they've told him to shove it.

    Anyway, at the end of the convo he asked about the deposit so I said leave it with me, I'll see what I can do but need to readvertise it first.
    We didn't fall out or anything but he knew I wasn't happy and to be fair, he didn't sound too impressed either.

    Question is, what should I do with the £200 deposit

    Morally I know I should give it him back and I do feel a bit of a tw&t for having it but legally who's is the £200 ?

    I'm thinking of giving him back £100 or £150 as I've had to readvertise it at additional expense plus deal with the wankers that are Joe Public for another week

    What do you lot think

    I don't know legally where you stand as you say morally he should get his money back if you didn't make it clear about the deposit being none refundable, however as the buyer he committed to buy with deposit so for messing you about he should leave deposit as compansation

        you have sold the car again, so imo, take the costs out what it owes you to re advertise it ect....and give him it back.

                A guy messed me about with my fiesta after giving me a £500 deposit.
                I kept the deposit as I said from the start it was non refundable

                  He pulled out of the sale, but it's your call at the end of the day, people here will say keep it or give back, as said your call at end of day buddy

                    I would split it mate £100 back and £100 for you for your fees and messing about more viewings and time etc

                      My missus would kill me, especially as I've still got this ST220! In two minds whether to keep or sell it, as my financial circumstances look like changing very shortly too.....
                      But I've spent a good bit on it and it's looking fab now, just needs a test.

                      And I'd go with what a few have said, he's probably not rolling in cash so give him half back, but don't give him it all because it might just make him think next time.

                        If you got full money I would give him the money bk , but if you had to take less than he was giving you , I would need to think about it,

                          i think i would have wrote him a receipt for his 200 quid and wrote across the top the "all deposits are non-refundable" then got him to sign it.

                            A depo is a dirty word...

                            I had trading standards tell me to use the phrase part payment as you can't wiggle out of it.

                            My advice Is this...

                            Never take a depo err part payment without saying clearly if you do its non refundable and if you ask its not gonna go down well.
